Terms of Service

1. Acceptance of Terms

By accessing or using utah-neat (the “Service”), available at utahneat.app, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not access or use the Service.

These Terms constitute a legally binding agreement between you (“you” or “User”) and Bonham Technologies LLC, a company organized under the laws of Utah, USA (“we,” “us,” or “our”). We may update these Terms from time to time; continued use of the Service after changes are posted constitutes acceptance of the revised Terms (see Section 12).

2. Service Description

utah-neat is an independent informational service that tracks and presents publicly available Utah Department of Alcoholic Beverage Services (DABS) whiskey inventory data. The Service allows users to browse product availability across Utah DABS stores, view price history, track stock changes, and — for Pro subscribers — receive email alerts when new bottles matching saved search criteria appear in the DABS catalog.

utah-neat is NOT affiliated with, endorsed by, or sponsored by the Utah Department of Alcoholic Beverage Services or the State of Utah. All inventory data is sourced from publicly available DABS data and is provided for informational purposes only. We make no representation that any particular product will be available for purchase at any specific store, and nothing in the Service constitutes an offer to sell any product.

The Service is intended for users who are 21 years of age or older, consistent with Utah’s legal drinking age. By using the Service you represent that you are at least 21 years old.

3. Accounts and Authentication

To set up bottle alerts or subscribe to Pro, you must provide a valid email address. We use a magic-link authentication system — instead of a password, a one-time sign-in link is sent to your inbox. You are solely responsible for:

• maintaining access to the email account you register with;
• the security of your email inbox (anyone with access to your inbox can sign in as you);
• all activity that occurs under your account.

You must provide accurate account information and keep it up to date. You may not register with an email address you do not own or have authority to use. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Pro Subscription

4a. Features and price

The Pro subscription (“Pro”) unlocks saved search criteria and nightly new-listing email alerts. The current price is $30.00 USD per year, billed annually. Pricing may change; we will give you advance notice before any change affects your renewal.

4b. Billing and auto-renewal

Payments are processed by Stripe. By starting a Pro subscription you authorize us to charge your payment method $30.00 USD at the start of each annual billing period until you cancel. Your subscription renews automatically at the end of each paid period unless you cancel before the renewal date.

We never see, receive, or store your full card number, CVV, or bank account details — all payment data is handled by Stripe and is subject to Stripe’s Privacy Policy.

5. Acceptable Use

You agree not to:

• scrape, crawl, or automatically extract data from the Service in a manner that places an excessive load on our infrastructure;
• use the Service for any unlawful purpose or in violation of any applicable federal, state, or local law;
• attempt to gain unauthorized access to our systems, other users’ accounts, or any backend infrastructure;
• transmit any viruses, malware, or other harmful code;
• use the Service to harass, spam, or send unsolicited communications to any person;
• misrepresent your identity or affiliation when using the Service;
• resell, sublicense, or commercially exploit the Service or the data it presents without our express written permission.

We reserve the right to suspend or terminate your access to the Service for any violation of these acceptable-use provisions, at our sole discretion.

6. Intellectual Property

The utah-neat website, including its design, code, text, and graphics (excluding third-party data and open-source components), is owned by Bonham Technologies LLC and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes.

Inventory and product data displayed on the Service is sourced from publicly available Utah DABS records. We do not claim ownership of that underlying government data.

Product enrichment data (tasting notes, age statements, and similar metadata) is sourced in part from WHISKY:EDITION (CC BY 4.0).

7. Disclaimers

To the fullest extent permitted by applicable law, we disclaim all warranties, whether express, implied, or statutory, and make no representations regarding the reliability or suitability of the Service for any particular purpose.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BONHAM TECHNOLOGIES LLC, ITS MEMBERS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, MISSED PURCHASING OPPORTUNITIES, OR ANY OTHER LOSS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNTS YOU PAID TO US IN THE 12 MONTHS IMMEDIATELY PRECEDING THE CLAIM, OR (B) USD $10.00.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages, so some of the above limitations may not apply to you.

9. Third-Party Services

The Service relies on third-party processors including Stripe (payments), Supabase (database and authentication), Resend (transactional email), and Vercel (hosting and analytics). Your use of the Service is also subject to the terms and privacy policies of these third parties. We are not responsible for the acts or omissions of any third-party service provider.

The Service may contain links to external websites. We do not endorse and are not responsible for the content, accuracy, or practices of any third-party sites.

10. Indemnification

You agree to indemnify and hold harmless Bonham Technologies LLC and its members, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of any third party.

11. Governing Law

These Terms and any dispute arising out of or related to them or the Service shall be governed by and construed in accordance with the laws of the State of Utah, USA, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the state and federal courts located in Utah for any dispute arising out of these Terms or your use of the Service.

12. Changes to These Terms

We may update these Terms of Service from time to time. When we make material changes, we will update the “Last updated” date at the top of this page. If you have an account, we may also notify you by email. Your continued use of the Service after updated Terms are posted constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.
